Streamy Awards Submission and Voting Guidelines
Effective August 1, 2012
1. Award Eligibility
The Streamy Awards are open to all original production, episodic, video series which were released under the same title, trade name or mark and initially distributed at least three (3) episodes via the Internet (i.e. first run via a video sharing site or unique URL, and not previously distributed via other media; provided, however, that certain previously distributed works, or portions thereof, may be eligible in the “Best Companion Entertainment” category) between November 1, 2011 and November 1, 2012 (each, a “Series”). Note that Series need not have been shot or produced during this time period. Works expressly excluded from eligibility are previews, trailers, sizzle reels, commercials, sequences from feature-length films for theatrical distribution or home video release, and episodes of established television series previously delivered on broadcast, pay or cable television; provided, however, that certain excluded works, or portions thereof, may be eligible in the “Best Companion Entertainment” category. To be eligible for award nomination, an individual or organization must have performed in or participated in the production of an eligible Series. Subject to certain category-specific requirements (e.g., without limitation, Best International (Non-US) Series must be produced abroad), Series are eligible for consideration in all Streamy Awards categories. Category-specific requirements are currently available at http://www.streamys.org/awards/the-categories/. Series, individuals and organizations may be nominated for and win multiple Streamy Awards. Series will be considered in the form that they appear online and must be posted online and available for review at a specified URL or Web page. Series that contain obscene or pornographic material, propagate “hate” messages, make defamatory statements, or which are otherwise offensive may be disqualified in the sole discretion of Dick Clark Productions, Inc. (“Company”). Final determination of eligibility is in Company’s sole discretion. Ineligible Series may be disqualified at any time without prior notification in Company’s sole discretion. All entrants and participants in the Streamy Awards are subject to, and must adhere to, these Streamy Awards Submission and Voting Guidelines, the Streamy Awards Terms of Use currently available at http://www.streamys.org/legal/terms-of-use/, and the Streamy Awards Privacy Policy currently available at http://www.streamys.org/legal/privacy-policy-2/. Company’s decision not to enforce any specific provision of these Streamy Awards Submission and Voting Guidelines does not constitute a waiver of such provision or of these guidelines generally.
2. Submissions
Company will accept submissions for the Streamy Awards from the public via Twitter only (each Tweet, a “Public Submission”) between August 15, 2012 and November 2, 2012 (the “Submission Period”). Company will also accept submissions for the Streamy Awards from the owner or authorized representative of any eligible Series via http://www.streamys.org/ only (each, a “Certified Submission”) during the Submission Period. By making any submission to Company, you signify that you (and your parent or legal guardian, if you are a minor in your jurisdiction of residence) have read and agree to these Streamy Awards Submission and Voting Guidelines, the Streamy Awards Terms of Use, and the Streamy Awards Privacy Policy. The Streamy Awards and related services are hosted in the United States. If you are a participant located outside of the United States, you consent to having any information you provide to Company transferred to and processed in the United States, where you understand data protection and other privacy laws may differ from those in your jurisdiction.
(a) Public Submissions
To submit a Series, individual or organization for the Streamy Awards via Public Submission, you must be a registered Twitter user. Log in to your Twitter account via http://www.streamys.org/ or via the Streamy Awards widget as may be available on third-party websites during the Submission Period and follow the instructions to Tweet your Public Submission. Only Tweets generated via http://www.streamys.org/ or otherwise via the Streamy Awards widget will be counted as Public Submissions (i.e. logging directly on to Twitter and Tweeting your preference for a Series, individual or organization, while permitted, will not be counted as a Public Submission). All Public Submissions are subject to the Twitter Terms of Service, currently available at https://twitter.com/tos, and the Twitter Privacy Policy, currently available at https://twitter.com/privacy. Additionally, any information you provide or authorize Company to access in connection with your Public Submission is subject to the Streamy Awards Privacy Policy, currently available at http://www.streamys.org/legal/privacy-policy-2/. You may submit yourself or your own Series for consideration. You may submit a Series, individual or organization in as many Streamy Awards categories as you wish, but you are limited to only one (1) Public Submission for any Series, individual or organization per category per calendar day. Public Submissions exceeding the limits stated above may be disqualified. Public Submissions in certain categories may have special instructions. Follow applicable instructions to make Public Submissions in one of these categories. Company reserves the right, in its sole discretion, to disqualify any Public Submission. Company will automatically disqualify any Public Submission activity that, in Company’s opinion, appears intended to game the system, violates trademarks, infringes copyrights, impersonates others, invades privacy, makes threats of violence, promotes illegal activities, promotes pornography, spams, uses bots, scripts or other automated means for voting, engages in abusive behavior, or promises anything of value in exchange for a submission. Any attempted method of submission other than as described herein is void. All Public Submissions must be received and recorded by Company during the Submission Period. Neither Company nor the Streamy Awards are in any way affiliated with Twitter Inc.
(b) Certified Submissions
If you are the owner or authorized representative of any eligible Series, individual or organization, you may submit the Series, individual, or organization for Streamy Awards consideration via Certified Submission by visiting http://www.streamys.org/ during the Submission Period and following the instructions for making a Certified Submission. Certain Streamy Awards categories require a fee for Certified Submission, as specified at http://www.streamys.org/enter/frequently-asked-questions/. All Certified Submission fees are non-refundable. Any Public Submission may later become a Certified Submission if/when submitted by the owner or authorized representative of the applicable Series, individual or organization. ONLY CERTIFIED SUBMISSIONS WILL BE ELIGIBLE TO BECOME OFFICIAL NOMINEES, STREAMY AWARD WINNERS, AND STREAMY AUDIENCE CHOICE AWARD WINNERS. All Certified Submissions and associated fees must be received by Company during the Submission Period. You will be required to register/login, fill out a Certified Submission form and provide certain other information in order to make a Certified Submission. Information you provide or authorize Company to access in connection with your Certified Submission is subject to the Streamy Awards Privacy Policy, currently available at http://www.streamys.org/legal/privacy-policy-2/. All information provided must be accurate, valid and completed in full, or your Certified Submission may be disqualified. Furthermore, names, credit details and other information you provide via Certified Submission may be published if the applicable Series, individual, or organization becomes an Official Nominee, Streamy Award Winner and/or a Streamy Audience Choice Award Winner, so please ensure that all details are correct at the time of entry. You must notify Company if any Series, individual or organization you submit is subject to any dispute or litigation with any third party regarding such Series, individual or organization. ALL CERTIFIED SUBMISSIONS WILL REQUIRE THE OWNER OR AUTHORIZED REPRESENTATIVE OF THE ELIGIBLE SERIES, INDIVIDUAL OR ORGANIZATION TO AGREE TO ALL OF THE TERMS AND CONDITIONS OF THE STREAMY AWARDS LICENSE AGREEMENT, CURRENTLY AVAILABLE FOR REVIEW AT http://www.streamys.org/legal/license-agreement/.
3. Official Nominees and Streamy Award Winners
For each category, the Series, individual or organization with the greatest number of Public Submissions during the Submission Period will be eligible to become one (1) of the five (5) official Streamy Awards nominees (each, an “Official Nominee”); provided, however, that in order to become the Public Submissions Official Nominee, the applicable Series, individual or organization must also have also been be submitted/certified via Certified Submission by its owner or authorized representative during the Submission Period. The remaining four (4) Official Nominees in each category will be selected by the Streamy Awards Blue Ribbon Panel (the “Blue Ribbon Panel”) choosing from among all remaining Certified Submissions in each category. If, in the opinion of the Blue Ribbon Panel, the eligible Series, individuals or organizations in any category fail to meet the Streamy Awards’ standard of excellence, fewer Official Nominees may be selected in the applicable category. If no Series, individuals or organizations meet the Streamy Awards’ standard of excellence in a certain category, Company may, in its sole discretion, cancel the Streamy Award in such category. The Blue Ribbon Panel will select the winner (the “Streamy Awards Winner”) among the Official Nominees in each category. If a Series, individual or organization is declared a Streamy Awards Winner, the manner and details of announcing its nomination and award remain strictly within the discretion of the Company. Official Nominees and Streamy Awards Winner understand and agree that not all Streamy Awards will publicized in the same manner, and that while some Streamy Awards might be presented in a ceremony, others might not. The Blue Ribbon Panel’s decisions regarding the Streamy Awards Winners will be final. Company reserves the right to withdraw any Streamy Award from a Streamy Awards Winner at a later date if Company later finds that the Streamy Awards Winner failed to comply in any way with these Streamy Awards Submission and Voting Guidelines.
4. Audience Choice Finalists and Streamy Audience Choice Awards
Company will bestow additional awards in the categories of “Series of the Year” and “Person of the Year” based on selections made by the voting public (each, a “Streamy Audience Choice Award). Up to ten (10) finalists (each, an “Audience Choice Finalists”) will be selected for each Streamy Audience Choice Award based on the greatest number of Public Submissions during the Submission Period; provided, however, that in order to become an Audience Choice Finalist, the applicable Series or person must also have also been be submitted/certified via Certified Submission by its owner or authorized representative during the Submission Period. Once the Audience Choice Finalists are selected from among the eligible/certified Series an persons, you may cast your vote (“Public Vote”) for any Audience Choice Finalists between December 19, 2012 and February 17, 2013 (the “Voting Period”) by visiting http://www.streamys.org/ or http://www.facebook.com/streamys, and following the instructions for submitting your vote(s). The Audience Choice Finalist with accumulating the greatest number of Public Votes in a category during the Voting Period will be declared the “Streamy Audience Choice Winner” in such category. You will be required to log in and provide certain information in order to submit your Public Vote(s). Information you provide or authorize Company to access in connection with your Public Vote(s) is subject to the Streamy Awards Privacy Policy, currently available at http://www.streamys.org/legal/privacy-policy-2/. All information provided must be accurate, valid and completed in full, or your Public Vote(s) may be disqualified. You may vote for yourself or your own Series. You may have the option of sharing your Public Vote(s) via Facebook, Twitter, Google +, and Share This. You are limited to only one (1) Public Vote for any Series or person per category per calendar day. Public Votes exceeding the limits stated above may result in disqualification of your Public Votes. Company reserves the right, in its sole discretion, to disqualify any Public Vote. Company will automatically disqualify any Public Vote activity that, in Company’s opinion, appears intended to game the system, violates trademarks, infringes copyrights, impersonates others, invades privacy, makes threats of violence, promotes illegal activities, promotes pornography, spams, uses bots, scripts or other automated means for voting, engages in abusive behavior, or promises anything of value in exchange for a vote. Any attempted method of voting other than as described herein is void. All Public Votes must be received and recorded by Company during the Voting Period. If, in the opinion of the Company, the Audience Choice Finalists in either category fail to meet the Streamy Awards’ standard of excellence, fewer Audience Choice Finalists may be selected in the applicable category. If no Audience Choice Finalists meet the Streamy Awards’ standard of excellence in a category, Company may, in its sole discretion, cancel the Streamy Audience Choice Award in such category. Company reserves the right to withdraw a Streamy Audience Choice Award from a Streamy Audience Choice Winner at a later date if Company later finds that the Streamy Audience Choice Winner failed to comply in any way with these Streamy Awards Submission and Voting Guidelines.

If you need to correct credits or show information, please contact us at support@streamys.org. While non-English speaking Series are encouraged, work must be accessible to our predominantly English speaking Blue Ribbon Panel members. In categories not dependent on language, non-English speaking entries may be considered in their original format. Otherwise, Series in a foreign language must be dubbed or subtitled into English. All participants hereunder (whether submitting, voting or otherwise) hereby release, agree to indemnify, and hold harmless Company, its affiliated and related companies, its other designees, and each of their respective parents, subsidiaries, companies and the directors, officers, agents and employees from any and all liability for any and all claims, costs, injuries, losses or damages of any kind arising out of their participation in the Streamy Awards, Company’s use of any Series and/or the unauthorized or illegal access to participants’ personally identifiable information. These Streamy Awards Submission and Voting Guidelines are subject to change without notice in Company’s sole discretion. All such changes will be posted on http://www.streamys.org/.
